Privacy Policy

I. Abbreviations and Definitions

Definitions:

GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC (General Data Protection Regulation) – Official Journal L 2016.119.1 dated 2016.05.04.

Joint Controllers – entities indicated in Section II, clause 1 of this Privacy Policy, who jointly determine the purposes and means of processing personal data, also referred to as “Rent4You.”

Client – the entity whose personal data is processed on any legal basis specified in Article 6 of the GDPR.

Cookies – text files stored by the browser on a computer or mobile device.

Profiling – any form of automated processing of personal data consisting of evaluating certain personal aspects relating to a natural person, in particular to analyze or predict aspects concerning that person’s performance at work, economic situation, health, personal preferences, interests, reliability, behavior, location, or movements.

II. General Provisions

The Joint Controllers of personal data are the following entities:

a. Apartamenty Olimpijska managed by Rent4You PL sp. z o.o. with its registered office in Olsztyn at ul. Sielska 38A/7, NIP 7393979673, REGON 524450460.

Under a joint controller agreement, the Joint Controllers have determined the scope of their responsibilities regarding compliance with GDPR obligations. In particular, they have agreed that:

a. The Joint Controllers are jointly responsible for fulfilling the information obligation towards Clients;

b. The Joint Controllers are jointly responsible for enabling Clients to exercise their rights under the GDPR. Accordingly, Clients may exercise their rights against any of the Joint Controllers.

RENT4YOU PL sp. z o.o. respects the right to privacy and ensures data security by applying appropriate measures proportional to the risks to the rights and freedoms of natural persons resulting from data processing.

IV. Purposes and Legal Bases for Processing

Personal data will be processed for 30 days for the purpose of:

a. Taking actions prior to concluding a contract at the request of the data subject or executing a contract for accommodation services to which the data subject is a party (data necessary for concluding the contract are indicated in the booking and accommodation service sales form) – based on Article 6(1)(b) GDPR;

b. Fulfilling legal obligations incumbent on the Joint Controllers (e.g., tax obligations) – based on Article 6(1)(c) GDPR;

c. Pursuing the legitimate interests of the Joint Controllers (including pursuing or defending claims, ensuring safety and protection of persons and property, executing contracts with third parties on behalf of the Client) – based on Article 6(1)(f) GDPR.

Providing personal data is voluntary; however, in cases where data is necessary to perform accommodation services, it is required for contract conclusion and execution.

Monitoring in publicly accessible areas is installed to ensure the safety of Clients and property protection.

V. Categories of Personal Data Processed

We process the following categories of Client personal data:

First and last name;

Residential address;

Email address;

Phone number;

Payment card data (if payment is made by card);

Information about stay dates;

Preferences regarding the stay;

Number of adults covered by the booking;

Number and age of children covered by the booking;

Data necessary for issuing VAT invoices;

Preferred language of communication.

VI. Data Recipients

We may disclose personal data to the following recipients:

LEMONPIXEL.PL Roman Korczyński, ul. Młyńska 12A, 58-570 Jelenia Góra, which operates the booking module on our website;

Other companies (including IT companies) cooperating with us in managing the services provided.

VII. Transfer of Data to Third Countries or International Organizations

We inform that personal data is not transferred outside the European Economic Area except when explicitly requested by the Client.

VIII. Data Retention Period

Personal data processed for the purpose of contract conclusion and execution, as well as for fulfilling legal obligations or legitimate interests of any of the Joint Controllers, will be retained for the duration of the contract and thereafter for the period necessary to:

a. Secure or pursue potential claims;

b. Fulfill legal obligations (e.g., tax regulations).

Data processed based on separate, voluntary consent will be kept until consent withdrawal, objection to processing, or until no longer necessary for the purpose, and thereafter for the statute of limitations period for claims.

Personal data in the form of images from monitoring recordings will be stored for up to 30 days and then permanently deleted by overwriting.

Detailed information on the scope and purpose of data processing, types of personal data, and retention periods are included in Annex 1 to the Privacy Policy.

IX. Your Rights

You have the right to:

a. Access your data and receive copies;

b. Rectify (correct) your data;

c. Delete your data;

d. Restrict data processing;

e. Object to data processing;

f. Data portability;

g. Lodge a complaint with a supervisory authority;

h. Withdraw consent to personal data processing at any time where processing is based on consent—withdrawal will not affect the lawfulness of processing before withdrawal.

X. Information on the Obligation/Voluntariness of Data Provision

Providing personal data is a condition for concluding the contract and/or providing services. Failure to provide data may result in refusal to conclude the contract or provide services.

XI. Information on the Data Source

If personal data were not provided directly by you, they were obtained from the entity that concluded a hotel service agreement with any of the Joint Controllers on your behalf or from the entity with which you made a reservation contract for services provided by the Joint Controllers.

XII. Copyright

All content and information on our website are the property of Rent4You PL sp. z o.o. and are protected under the Act of 4 February 1994 on Copyright and Related Rights (consolidated text: Journal of Laws 2017, item 880 as amended), especially regarding use, display, copying, transmission, dissemination, modification, or deletion.

Any actions listed in point 1 require written consent from Rent4You PL sp. z o.o. Unauthorized use will be considered illegal and infringe on the company’s intellectual property rights.

XIII. Cookies

The website uses cookies for statistical and service personalization purposes.

Clients can manage cookies within their web browser settings.

Disabling cookies may cause difficulties in proper website functioning.

XIV. Final Provisions

The Joint Controllers reserve the right to amend the Privacy Policy.

The Client is bound by the current Privacy Policy posted on www.rioapartamenty.pl at the time of entering into the service contract.

INFORMATION FOR BOOKING CLIENTS

Check-in begins at 3:00 PM and check-out is by 11:00 AM.

The price per night shown in the booking confirmation is the cost for renting the apartment for one night.

Accepted payment methods for reservations depend on the selected offer and include: cash or credit card on site, traditional bank transfer, and online transfer.

Guaranteed reservations require full payment immediately after booking via available payment methods. The amount is 100%.

In case of cancellation or shortening of stay without meeting the specified deadlines, or in case of no-show, the property reserves the right to charge reservation fees.

For bookings priced in EUR, the Polish złoty equivalent is calculated based on the foreign exchange rate multiplied by the average EUR rate according to the National Bank of Poland’s table on the day before arrival.

Under Article 38 point 12 of the Act of 30 May 2014, the Client has no right to withdraw from the contract.

The complaint procedure for individual clients (consumers) of Rent4You PL sp. z o.o. is included below this booking confirmation.

COMPLAINT PROCEDURE FOR INDIVIDUAL CLIENTS (CONSUMERS)

Rent4You PL sp. z o.o., located in Olsztyn at ul. Sielska 38A/7, NIP 7393979673 (hereinafter “Rent4You PL sp. z o.o.”), processes complaints submitted by Clients in accordance with this procedure, unless the legal relationship between the Client and Rent4You PL sp. z o.o. states otherwise.

For this procedure, “Client” means a consumer under the Civil Code Act of 23 April 1964 using services provided by Rent4You PL sp. z o.o. and submitting a complaint.

A “Complaint” is a Client’s written statement or email sent to Rent4You PL sp. z o.o., regarding violation of Client rights related to services offered by Rent4You PL sp. z o.o. The complaint should include Client identification data, contact details, and a detailed description of the issue.

Written complaints should be sent to Rent4You PL sp. z o.o., ul. Sielska 38A/7, 10-083 Olsztyn; electronic complaints to kontakt@rent4you.com.pl.

Clients should report complaints promptly after learning of the issue to ensure effective handling.

Upon receipt, Rent4You PL sp. z o.o. will take steps to consider the complaint. Authorized staff may contact the Client to clarify facts or request additional information.

Complaints will be handled in writing or by email response.

Responses to complaints will include: a factual and legal justification (unless unnecessary), relevant contract or property rules references (unless unnecessary), and contact details of the respondent.

Complaint responses will be provided within 14 days of receipt.

Any decision on compensation or refund requires management approval.
